Atty. Rivera’s message to Comelec on SOCE filing extension: “Ano naman ito?”

In light of the Comelec En Banc’s 4-3 decision, granting the request of LP for an extension, the news has sent shockwaves across the social media realm.

Speaking of which, a popular social media personality published an open letter addressed to the Comelec lambasting another unpopular poll body decision.

As of this writing, the post of Atty. Bruce Rivera has generated favorable response concurring with the view of the writer.

COMELEC, YOU HAVE A DUTY

The 1987 Constitution gave the Comelec the daunting task of assuring the conduct of fair and honest elections. Such is both a mandate and an obligation the body has the duty to uphold.

Regulating campaign expenses is a big part of assuring fairness in the electoral process or else, we will be electing leaders not because of qualification but of net-worth. Hence, rigid rules are set on the submission of reportorial requirements of parties and candidates pertaining to campaign expenditures. It is also mandatory in character and may admit of exceptions under exceptional circumstances. As a result, you have disqualified several elected officials because they failed to submit these reports on time.

The concept of an extension of a deadline contemplates something that is done before the actual deadline. Kaya nga deadline, kasi patay na nung June 8, 2016. Hindi pwede i-extend ang naglapse na. Kasi nga, hindi na pwedeng buhayin ang patay na. If they extended the deadline to June 30, 2016 before June 8, 2016, that could have been acceptable.
In short, eto ang masasabi ko: ANO NA NAMAN TO?!!!

Meanwhile, the reaction of Dr. Antonio Contreras of De La Salle University to Comelec’s decision granting extension to the submission of SOCE summarizes the general feeling of the netizens.

Shameless! This decision has further weakened the rule of law. Someone has to challenge this decision and elevate this to the Supreme Court. I would gladly do it except that I do not have legal standing.
