Embarrassing! A non-lawyer explains to lawyer VP Leni Robredo, lawmaker Grace Poe the what and why’s of “gag order” plea to cancel ABS-CBN’s franchise

The GAG orderĀ on plea to cancel ABS-CBN’s franchise has been interpreted by the Opposition camp led by VP Leni Robredo and supporters of Kapamilya as an attempt to suppress the truth from coming out.

This is embarrassing! Facebook blogger Noel Landero Sarifa, a non-lawyer, give VP Leni Robredo who is a lawyer and even Senator Grace Poe, a lawmaker, has been given a free lecture on the essence of the gag order request by the OSG.

Sarifa clarified that the gag order request is not to suppress press freedom and free speech of showbiz personalities. “Ang pagrequest ng Gag Order ay hindi po pagtatakip ng bibig ng media at ng mga artista.”

According to him, the purpose of the gag order is to allow the hearing and decisions of the Supreme Court are based on the complaint and evidence presented by both camps. “Ito ay para ang pagdinig at desisyon ng Korte ay nababasi sa reklamo at ebidensyang iprenesenta ng Solicitor General at mga depensa na ihahain ng ABS-CBN.”

Sarifa remarked this is important to avoid influencing the decisions of member of the Supreme Court by the dramas and noise created by the media and showbiz stars. “Kailangan po ito para hindi maimpluwensyahan ang desisyon ng korte sa mga kadramahan at ingay na ginagawa ng media at mga artista, daming paawa effect sa TV.”

Sarifa clarified that press can still discuss other issues, hence the allegation that the gag order is a suppression of press freedom is unwarranted. If they have something to do with the case, Sarifa said they can approach the Court to present their evidence. “Maari pa rin magtalakay ng ibang issue ang mga media, kaya hindi ito suppression of freedom of the press. Kung may kinalaman sila sa kaso at nais magdulog ng kanilang hinaing at ebidensya pumunta sila sa korte. Tsaka may exemption ang Gag Order.”

Sarifa said whether the network have helped millions and made lot of Filipinos smile and happy but because they’ve been found in violation of the Constitution. “Hindi dahil maraming natulungan, hindi dahil napasaya tayo at napangiti, kundi dahil may nakikitang paglabag sa batas.”

Sarifa explained that a person who is good and God-fearing does not mean he is free to go if he commits a crime, the court will decide his guilt or innocence. “Ang taong mabait at makadiyos ay hindi dahilan ng kanyang pagkaabswelto sa isang kaso kapag nakagawa sya ng krimen, ang desisyon ay nasa korte.”

Sarifa concluded that the law is the law. Who will be followed, the Senators? Congressmen? The Constitution? “Ang batas ay batas, sino ba ang masusunod ang mga senator? congressman? artista? Oligarch? O ang saligang batas ng Pilipinas?”
