Lawyer angrily corrects Grace Poe re statement Senate co-equal branch of Executive & Judicial branches, wants Ombudsman & SolGen to look into this

Senator Grace Poe defended her decision to proceed with the senate hearing despite warning that she and the Senators can be held liable for violating the Constitution.

Poe remarked that many tried to stop or questioned the senate hearing, but the Senate maintains its position – the Senate is a co-equal branch of a republic and democratic government. She said it is important to maintain the balance and separation of powers.

However, Senator Poe’s phrase “kapantay na sangay” or co-equal branch has raised the eyebrows of a lawyer and FB blogger using the handle “Nick Nañgit – NCN Law”.

In the Facebook post, Nick Nañgit – NCN Law asked Poe what the heck she meant by co-equal branch? He asked if the Senator read the Constitution that states that a private bills shall emanate from the HoR (House of Representatives? The lawyer lectured Poe that there is only one Congress and the Senate is just part of it, it is not above the Lower House. “Anong pinagsasasabi mong “kapantay na sangay”? Nagbabasa ka ba ng Saligang Batas na malinaw ang pagkakasaad na ang mga panukalang pribado (o private bills kung saan nahahanay ang isang prangkisa ng isang public utility) ay dapat magmula muna sa Kapulungan ng mga Kinatawan o House of Representatives (HoR)? Kung di pa ipinapadala sa Senado ang bersyon ng panukalang batas ng HoR, wala pa kayong diringgin! Anong saysay ng pagdinig na yan na ginagastusan ng pera ng taumbayan? Iisa ang Kongreso, at bahagi lamang ang Senado ng Kongreso, hindi nangingimbabaw.”

The lawyer expounded further his explanation to Poe as to the meaning of the separation of powers in the branches of government to drive home the point that the Senate is not co-equal branch of the Executive and Judicial branches of government. “Ang magkakapantay na organisasyon sa sistema ng pamahalaan ng Pilipinas ay ang Ehekutibo (o ang Pangulo), ang Hukuman (o Judiciary), at ang buong Kongreso. HINDI kalebel ng Senado ang dalawang naunang nabanggit!”

The lawyer went on to admonished Poe for what her committee and senate hearing had done to the Constitution, making it worse that there is an alleged conflict of interest involved in the issue of ABS-CBN franchise renewal senate hearing. “Sa pagsapaw ng komite mo sa usapin ng prangkisa, lumilitaw na niyurakan ang Saligang Batas. Sinisira mismo ang balanse ng demokrasya at republika. Gumagawa ng sariling batas. Nilalabag ang batas! Abuso yan sa isang opisina, lalo pa’t napapabalita na may “conflict of interest” daw, dahil sa koneksyon ng tinuring mong pamilya (kung saan diumano’y ampon ka lang) sa iyong inang hahawakang komite.”

The lawyer remarked that Poe has sworn to uphold the Constitution and yet what happened? According to him, the Ombudsman and SolGen should look into this. “Nanumpa kang paninindigan mo ang Saligang Batas, pero ano itong nangyayari? Kelangan ang pagkilos dito ng Ombudsman at SolGen sa mga nagmamaru, lalo pa’t tinaguriang mambabatas, pero hindi alam o hindi sinusunod ang batas!”
