As per Manila Bulletin article dated July 17, 2018, former President Benigno Aquino III accused the NBI of violating due process in probe over Dengvaxia.
Aquino was quoted telling reporters in a press conference he himself called, “Hindi ko naintindihan kung pano nagkaroon ng due process doon.”
Aquino said in the press conference he was surprised that the NBI had come out with its findings and filed a criminal complaint last Monday before the Office of the Ombudsman recommending that he be indicted for technical malversation under Article 220 of the Revised Penal Code (RPC). Aquino recalled he was only summoned once to the NBI office via a subpoena on May 25 during the entire probe.
Former President Aquino’s claim of “lack of due process” has been met with raised eyebrows from lawyer Trixie Cruz-Angeles.
Angeles dismissed Aquino’s “lack of due process” claim on Facebook unfounded, calling Pnoy elitist” and accusing the former President of playing the victim card.
She went on to lecture Pnoy about the role of the NBI, in case the former President was unaware.
Angeles said the role of the NBI is evidence gathering and they are not required to give him a copy of the complaint.
Angeles explained it was not a preliminary investigation in the fiscal’s office wherein the accused may asked for a copy of the complaint. Due process, according to Angeles, is limited to the presence of his lawyer and the right to remain silent.
Angeles remarked that Pnoy was lucky he was not reproached or shouted at in the NBI for acting like he was ignorant of the process.

Buti nga nung pumunta kayo dun, di ninyo katabi yung ibang bagong huli na umaalingasaw ang amoy dahil pawis sa attempt nyang takasan ang pagaresto. Buti wala kayong kasamang lasing o hinuli sa bagansya.
Pero amoy na amoy pa rin kayo, sir. Amoy yung feeling entitled ninyo. Yung gulat ninyong bakit kayo kinakaladkad sa NBI ng ganyan.
