Political Science prof accuses Ombudsman Morales of ‘selective justice’, warns of possible impeachment

If indeed Conchita Carpio-Morales ordered the dismissal of Senator Villanueva of Rep. Yap, which is a clear violation of RA 6770, this is even a possible ground for impeachment.

This is the bold prediction of Dr. Antonio Contreras in light of the controversy surrounding the dismissal order against Senator Villanueva.

He also accused Ombudsman Conchita Carpio-Morales of playing selective justice.

Dr. Contreras warned the defenders of Ombudsman Morales not to cite the order dismissal of Senator Villanueva as the proof that the Ombudsman is only enforcing the law without looking at party affiliation.

According to him,  Senator Joel Villanueva broke ranks from LP and voted to oust Leila De Lima.

Meanwhile, Dr. Antonio Contreras believes that Ombudsman Conchita Carpio-Morales basis for ordering the dismissal of Senator Villanueva is erroneous.

Her order to dismiss Senator Villanueva is erroneous as it violates RA 6770 (Members of Congress are not under her disciplinary authority). She should just have filed a complaint against him with the Sandiganbayan, Same goes to Bohol Rep, Yap, who she also ordered dismissed.

Dr. Contreras offers the “sacrificial lamb” theory to explain the dismissal order from the Office of the Ombudsman headed by Conchita Morales.

Senator Villanueva may in fact be a minor player in the LP and is one of the dispensable ones offered to be sacrificed to avoid appearing too selective.

Dr. Contreras cited the cases of jailed former senators who served until the expiration of their terms.

Senators Enrile, Revilla and Estrada were jailed upon orders of the Sandiganbayan, but never were dismissed from being Senators.

Ground for impeachment against the Ombudsman?

According to Dr. Antonio Contreras, if indeed Ombudsman Morales ordered the dismissal order of Sen. Villanueva and Rep. Yap of Bohol, this could be use as ground for impeachment against her.

If indeed Conchita Carpio-Morales ordered the dismissal of Senator Villanueva and Rep. Yap, which is a clear violation of RA 6770, where her disciplinary powers as Ombudsman do not apply to members of Congress, this will show that she is ignorant of the law that created her own Office (the 1989 Ombudsman Act), or that she is already getting forgetful.

If push comes to shove, this is even a possible ground for impeachment.
