After the embarrassing defeat of the impeachment case in Congress, Rep. Alejano said he is taking the case to ICC. But not too fast says the experts.
La Salle Prof. Antonio Contreras cautions Rep. Gary Alejano on Facebook and told him to stop watching American TV shows like Scandal and Designated Survivor.
“Those who believe that Alejano can just go to ICC with his dismissed complaint, on the ground that he could not get fair treatment in the Philippines should stop watching Scandal and The Designated Survivor.”
Contreras said ICC is not an appeals body.
In addition, the Philippines is not a failed state and the courts are not functioning.
“And it takes jurisdiction only when a state or its court system are no longer functioning. And this only happens in failed states.
To prove that a state is a failed one requires a very high bar of evidence. And Alejano and his cohorts will have to argue that there is a widespread breakdown of institutions.”
International relations expert Sass Rogando Sasot couldn’t help herself but laugh at Alejano’s plan to run to the ICC in Hague.
“Si Alejano raw ay pupunta ng ICC dahil na-reject ang kanyang impeachment complaint. So pupunta ka ng ICC para ma-impeach si Duterte? Anong klaseng kaputahan iyan? Binababoy ninyo ang ICC. Dioskopo.”
International law expert Atty. Paula Defensor Knack agreed with Prof. Contreras.
On Facebook, she wrote, “Sinong sisihin mo eh yung video nagpapakita na HINDI NINYO ALAM ANG LAW ON EVIDENCE, PERIOD. Akala nyo madali mag-comply sa batas ha.”
Knack shared a meme articulating her opinion of Alejano’s ICC plan.
