Is Angel Locsin legally liable for the de@th of the senior citizen? Two lawyers weigh in

Now the Angel Locsin has issued a public apology, extended monetary help to the family of the senior citizen who died while queuing to receive relief goods during the Kapamilya actress’ birthday pantry event, netizens are asking: Is Angel Locsin legally liable for the death of the old man? Are her intentions sufficient legal defense?

Let us read the sides of two legal opinions from the Opposing camp.

First, let us heed to Twitter and borrow the tweet of Mel Sta. Maria, lawyer, broadcaster and a known supporter of the Opposition.

According to Atty. Mel Sta. Maria, Angel Locsin is not liable at all.

“Angel Locsin is not liable at all. There is no crime when there is no criminal mind. Neither was there negligence in putting up a table as community pantry. It was just there to be approached. It wasn’t also an accident due to any action of Angel Locsin.”

Atty. Trixie Angeles-Cruz of the FB page Luminous by Trixie Cruz-Angeles & Ahmed Paglinawan begins by defining criminal liability in simple terms to help us non-lawyers understand the concept and give us an idea whether the Kapamilya actress is criminally liable for the death of the senior citizen.

Towards the end, Atty. Trixie mention the possible case that can be filed against the actress – reckless imprudence resulting in homicide and asks if she’s liable? The answer is, “the evidence dictates.”

But one thing is clear, Atty. Trixie says Angel Locsin can be sued for civil liability.

Here’s the full post below.

Criminal liability.

Dalawa ang forms ng crime. Yung may intention, yung wala.

Because you are liable for even the UNINTENDED consequences of your actions.

Liable ba si Ms. Locsin sa reckless imprudence resulting in homicide? madidikta yan ng ebidensiya.

PS. May civil liability po kahit walang criminal liability, kung may damage na nangyari, in this case maliwanag na meron.

Thoughts?
