Lady lawyer lectures ANC Headstart host Karen Davila on GAG order 101, assures TV host objective reporting exempt from a gag order

ICYMI, SolGen Jose Calida asked the Supreme Court yesterday to issue a gag order on plea to cancel ABS-CBN’s franchise to stop ABS-CBN lawyers, persons associated with or connected to it are prevented from riling up the public with propaganda.

ANC Headstart host Karen Davila immediately took to Twitter to question the GAG ORDER, “Now a GAG ORDER? Asking a media company not to say anything on media…to the media? Mabuhay ang malayang pamamahayag.”

The admins of the FB Luminous by Trixie Cruz-Angeles & Ahmed Paglinawan, both lawyers, wasted no time in posting a rebuttal on their page, to educate the ANC host Davila what is a GAG ORDER.

But before that, Atty. Trixie remarked that Davila’s tweet is inaccurate and warned the public the motive behind the tweet. “Ms. Davila gives the impression that the gag order is to silence the entire station. This is inaccurate.”

Atty. Trixie explained to Davila the purpose of the GAG ORDER and read, “The gag order requested by the SolGen is to ensure that ABS CBN and all persons associated with or connected to it are prevented from riling up the public with propaganda.”

Atty. Trixie further explained that the GAG ORDER isn’t what the ANC host is implying on her tweet but to ensure fair trial for both parties. Otherwise, public opinion might influence the justices by their commentary. “This ensures a fair trial. Because the justices will not be unduly influenced by their commentary. After all, how can anyone avoid a media company as large as ABS, with a nationwide reach and affiliates all over the country? Also the propaganda tends to feed itself, that is, they are reported by other media, echoing and spreading their views, their side.”

Like in any rule, Atty. Trixie remarked there is always an exception and wrote, “Objective reporting is exempt from a gag order. That is, if the news merely indicates what was filed, what are the contents, dates of the hearings, then that is not covered by the gag order.”

Atty. Trixie said this isn’t new. She cited the GAG ORDER issued on both parties involved in the Bongbong Marcos’ election protest versus Leni Robredo. “Also, this is not new. Only recently, the SC issued a gag order on both Leni Robredo and BongBong Marcos in their election case pending before the Presidential Electoral Tribunal.”
