Yesterday, Atty. Jude Sabio’s photo proudly holding the 77-page complaint he filed against Duterte before ICC in Hague has been making the rounds online.
While Duterte’s critics received the news full of hope that Duterte’s time in Malacanang is nearing its end, international law expert Paula Defensor Knack says otherwise. Let us read the Facebook post of the esteemed international legal expert and sister of the late Senator Miriam Santiago.
On the ICC : Its a propaganda war where lawyers earn big 🙂
Filing a complaint does not immediately make the complaint a case for hearing under the Rome Statute of the ICC. There is a process for that.
Even if it becomes a situation, if cases were filed in domestic courts, the ICC has no jurisdiction. The Court must let the domestic jurisdiction prevail because that is the procedure of the ICC unless courts are not functioning (ex. war). Lascanas and Matobato have to fight it our in domestic courts first because cases are already pending. The ICC is a court of last resort. It is not the same as a regional trial court.
Several suspects with arrest warrants are even travelling and cannot be brought before the court.
So what do you make of the political maneuverings of Duterte’s enemies? Well, your guess is good as mine.
In the first place, Atty. Jude Sabio is not even qualified to practice before the ICC. That is according to Atty. Paula Defensor Knack.
Like Atty. Paula Knack said, the ICC complaint against Duterte and other personalities are merely part of the propaganda war.
In case Atty. Sabio’s complaint will prosper, Atty. Paula Defensor Knack gives Atty. Sabio a look of what awaits him.

In the following post, Atty. Paula Defensor Knack give the public a glimpse of one of the political strategies of Duterte’s enemies.
“This week, the President hosts the ASEAN Summit with China as a friend and the much awaited historical Code of Conduct on the sea is now scheduled for negotiations. Is the propaganda war now very clear ? 🙂 🙂 🙂 Remember, nothing can happen if the President has popular support. An approval rating of the President at 86% is extremely popular, again according to the NY Times itself.”
In the meantime, all we can do is just wait and see.
