Pro-Duterte lawyer to Kabataan Rep. Sarah Elago: “Hoy Ale, HUWAG KANG MAGKALAT NG K@T@NG@H@ MO!”

A News5 meme which embedded the statement of Kabataan party-list Representative Sarah Elago describing red-tagging or linking someone to the rebel armed groups as very alarming because it endangers the public and all those targeted by red-tagging circulates online.

Elago talked about the emotional impact of the red-tagging, which instead of having a public discourse on important issues about the youths, it appears to have the opposite effect. And, turned the spotlight on baseless accusation that can’t even stand on the court.

Atty. Nick Nañgit of the FB page Nick Nañgit – NCN Law dismissed Elago’s claim that red-tagging puts her life in danger. Atty. Nick angrily told Elago to stop spreading her stupidity.

Atty. Nick remarked that harm will only come to Elago if she joins an organization declared by the court as terrorist or commit a terroristic act. Atty. Nick added that mere allegation is unacceptable. There is a need to prove the accusation because there is such a thing as “due process” given by the state.

“Mapapahamak ka lang kapag sumanib ka sa mga organisasyong ituturing ng korte na terorista o kaya’y gumagawa ng mga aktong terorismo. At dito hindi pwede basta satsat. Kinakailangang patunayan muna ang mga akusasyon, dahil may “due process” ang Estado.”

Atty. Nick informed Elago who can a file a case against her and that is the Anti-Terror Council, given there is a “probable cause” she violated the new law called RA No. 11479 aka Anti-Terror Act.

“At ang magsasampa ng kaso laban sa iyo ay ang Anti-Terror Council, kapag nakita nitong may “probable cause” na nilabag mo ang bagong batas na Republic Act No. 11479 o yung tinatawag na Anti-Terror Act (ATA)!”

Atty. Nick fielded three questions to Elago in quick succession. If Elago answers in the negative, then she has no reason to be afraid.

“Bakit ka nababahala ngayon???

Sumanib ka na ba sa mga CPP NPA NDF?

O kinakanlong mo ba ang mga kabataan na armadong nakikibaka?”

Hence, Atty. Nick reckoned the likes of Sarah Elago and pals are strongly opposed of the ATA (Anti- Terror Act) because he was sure crimes committed by the CPP NPA NDF in connivance with its legal fronts is covered by it.

“Kaya kayo ng Kamatayan bloc sa Kongreso ay kontrang kontra sa ATA e dahil sa mga Seksyon 6 hanggang Seksyon 10 nito na tiyak pasok na pasok ang mga katarantadühang ginagawa ng CPP NPA NDF, kasabwat ang mga legal fronts nila. Ilang kabataan at katutubo ang dinodoktrina sa kabuktutan at maling pananaw, kasabwat ang mga legal fronts nila? Ilang mahihirap ang pinapaalab lang ang damdamin laban sa pamahalaan, para sumanib din, kasabwat ang mga legal fronts nila? Ilang sundalo at pulis ang pinapatay, at ilang bomba ang pinapasabog, kasabwat ang mga legal fronts nila?”

Atty. Nick asked Elago to categorically deny whether her party is a legal front or not.

“Legal front ba ang Kabataan Party List mo?”

Otherwise, Atty. Nick wants Elago to condemn the CPP NPA NDF.

“Kung hindi, ikondena mo ang CPP NPA NDF!”

However, Atty. Nick said that Elago can’t do this and wrapped up the FB post by cursing Elago.
